Patentability Criteria

• An invention is patentable only if it meets the following requirements:
• The invention must be statutory
• The invention must be new - not published in India or elsewhere
• The invention must be useful
• The invention must be non-obvious
• The invention must not have been disclosed to the public prior to the application for the patent.

Required Documents

Documents required for Patent Registration are as follows:

• Name and address of applicant
• Country of residence of applicant or corporation
• Copy of specification in English
• Duly signed General Power of Attorney in original
• Invention Disclosure Form (IDF) in original

Timeline for Patent Registration

Normally, Patent Registration Certificate is issued after 42 to 60 months, provided there is No objection / opposition being done.

Validity and Renewal

Patent Registration Certificate is valid for 20 years from the date of application provided it is renewed annually.

After the grant of patent, every patentee has to maintain the patent by paying renewal fee every year. For first two years, there is no renewal fee. The renewal fee is payable from 3rd year onwards. The patentee has choice to pay the renewal fees every year or he can pay in lump sum as well. In case the renewal fee is not paid the patent will be ceased.
